OPEN LETTER TO THE 110TH CONGRESS, 2ND
SESSION

Representatives:
We are concerned these FY09 NDAA, TITLE VI,
Subtitle C Sections will be applied retroactively to service
personnel who divorced on or after 25 June 1981. Please assure us
this isn't the case, and consider adopting the following amendments
to:
- S2787/HR5658, Sec. 621: mandate training,
provided by unit commanders, advising all personnel in their
charge of this enforcement policy change
- S2787/HR5658, Sec. 622: require the
divorcing spouse to establish a court ordered SBP account at the
time of divorce. This will render the need to remember to apply
for this, in the future, moot.
- S2787/HR5658, Sec. 623: allow former
spouses to apply for the amount of SBP insurance they can afford
to pay for. Service personnel should only be responsible to
provide for their surviving spouse.

- S2787/HR5658, Sec. 626: mandate training,
provided by unit commanders, advising all service personnel in
their charge, this protection has been removed
